    If you have any questions, need help in any way or just want to know something - please feel free to PM any of us, and we will be more than happy to help you in any way we can. If we don't know the answer - we will go find it.

    This is a Copyright aware forum,
    We allow CILM, CDO, PTE, AMI, PFD, MPT, UYA, MTA, TART and independant artists As long as, you have a proper license.
    We also allow General Permission artists, please read our copyright info below

    Terms of Use
    Please ensure you follow the artists Terms of Use when using their artwork.
    Some artists/licensing companies do not allow animation of the tube, some only allow certain animation to the tube. Glitter & special effects are usually permitted in your tag, but if you wish to modify the tube in anyway please check the TOU of the artist and the Licensing company.
    Some deviant art or other artists websites sites do not have a TOU.
    If there is no TOU assume this artist is Group Permission.

    Licensed and Independant Artists
    If you wish to use Licensed & Independant Pay-to-Use (PTU) artwork please ensure you add the correct copyright and your Licence number to your siggy. ie ©artist artists URL (website address). You can add taggers details and date but please do not add tubers information. This is subject to change from time to time.

    Free to use Artists - General Permission
    If you wish to use an Free-to-Use artist (FTU), can you please check in the General and Group permission folders to see if they are ok to use. It is important that we use only GENERAL PERMISSION artists on this site. Please remember to add the correct copyright. This is subject to change from time to time.


    Free to use Artists Group Permission
    You cannot use Group Permission artists on this site as we do not have written permission to use them. We will not apply for site permission to use these artists. This is subject to change from time to time.

    You can apply for Personal Permission to use them. If you have personal permission to use the artists work can you please let Admin know and send a copy of the written permission to admin so that we are aware and can make a note for future use.

    Updates to Artists TOU and status
    There are constant changes and updates so we will try to keep this section uptodate, but this is constantly subject to changes, and open to errors and omissions.

    You could help us by letting us know if an artist has changed their TOU, or Revoked Permission or they switch to one of the Licensing sites or you spot an error. Please pm Admin or Post a message in the copyright Info Thread

    PTU Scrapkits
    Some PTU Scrapkit makers require a copyright, their terms of use will recommend how you should add this especially if you are/or not using another artist work with the kit. This is subject to change from time to time.

    Royalty Free Photography
    Some Photography requires a copyright, ie courtesy of photographers name/website if used with a PTU/FTU tube then only use the copyright symbol with the artist and not the photographer. Some photographers cannot be used with another artists work, please read the TOU before using This is subject to change from time to time.

    Reminders
    Ocassionally we may need to remind you if you have forgotten to use a copyright or accidently used a Group permission artist. If it is not changed we may have to remove the tag from the post. It is not possible to spot all errors and omissions, the onus is on the tagger to ensure they add the correct copyright information.

    No Blank Tags
    All PTU artists have it in their TOU's that there will be no blank tags. So out of respect to our FTU Artists they will get the same courtesy as the PTU artists here. No Blank Avatars either....they must have your initial or name on them as well as any proper copyrights.

    I am assuming that you mean actual pictures or cartoon character artwork and not artwork that has been made to look like these images. So the answer is no. They are not legal to use unless you have written permission from the person/company/photographer that owns the actual copyright. For example Disney, Summit Entertainment, Warner Bros, Celebrity photographers, etc. If you do not have permission to use these then you simply can't use them. Just for reference adding Fan tag to the tag does not make it legal. Adding © Disney etc does not make it legal. The only thing that makes it legal is actual permission to use these images. They belong to someone and using them without permission is violating someone's copyright. I would advise staying away from any tutorials or tags that use these images unless the person or you has permission to use the image in question. Nor would I make any websets, logos, etc with them unless I had permission to do so.



    PAID GROUP PERMISSION;
    Pay to Use (PTU) artists require their artwork to be purchased through the licensing companies and the appropriate license from the company to be use in conjunction with the purchased image/tube. Other guidelines might also apply. (A "paid group permission" would fall in this category, however it holds the additional restriction that it ONLY can be used for those within the group specified in the paid permission. For example, DLT/DLT-AD as well as the Shewolf groups have a paid permission for Nadezhda Strelkina and only those who are current members in any of those groups can use her tubes/images, provided the guidelines to the permission are followed, which includes that the tubes for this artist NOT be shared outside of the DLT/SWD groups.)

    Deviant Art Artists
    The thing is with some of the DA ( Deviantart) artists, is that they are photomanipulation experts or learning photomanips, now these are using stock models, and other stock photography, sometimes these artists will paint pieces, backgrounds, enhancements like jewellery, gothic looking bats, tears, blood stains and so on, but basically the term Manipulation is the blending and manipping of various images to create a new image..

    In most cases because they used various stocks the actual Manipulator will either say No off DA use, No use at all, or you will have to get permission from the stock artists if you wish to use my work..

    Another reason, its not always a good thing to request permission from an artist you know manipulates alot of stock in one image, and in Eireen aka Anne Claire Payet's case she is a photomanipulation artist, i expect that is why she has these terms, the original model is from Ailinstock aka Ari and Rachel Ailin and they would have their own rules as to what they allow like most stock artists..

    Company Logos and the use of Harley Davidson Motorcycles in Scrapkits is not permitted.


    We had an issue a while back, some of you may remember, about Harley-Davidson being used in scrap kit someone was selling. Many of you knew that this was a huge no-no but I know some wrote this person and were assured it was ok – trust me, it was not.

    We know the above because we spoke to Harley-Davidson and what they told us is this:

    You are allowed to use photographs showing cars/motorcycles for non-commercial purposes so long as you are the one that takes the photo and they are not photos from a magazine; the same would hold true for these cars. It’s the overall image of the car you are using, not the “logo” of the car and there is a difference. You may also tube the photos and allow others to use them but again, no money may be made from them.

    Also, Harley went on to state the following:

    Photo Bucket has been given instructions from Harley-Davidson to remove any images bearing the Harley-Davidson logo. The reason is because people from there take those images based on an impression that it’s ok to use that work freely and then they offer up merchandise for sale using those images so you must be aware of that. They must do this to protect their trademark so if you happen to take a photo of something such as this I wouldn’t use a public type photo album to display or keep them.

    Because we have members that also create stationary I want to go a bit further and include an additional comment made by Harley – this is verbatim:

    “It would also be inappropriate, and consequently objectionable, for people to create “stationary” containing our logo except for “purely personal” correspondence. Please understand that our logo is not merely a “decoration” or “theme”. It servers a very specific legal function, which is to identify Harley-Davidson itself and its products and services. It is purely commercial symbol and should only be used by authorized dealers and licensees in the conduct of their business”. So, stationary would not be permitted.

    I hope that answers some questions and makes things more clearer for everyone.
